Today, Monday, the heads of the judicial councils will start installing specialized and newly created commercial courts across 12 states, whose tasks are based on all disputes related to commercial affairs.
A statement by the Ministry of Justice stated that the heads of the judicial councils will, starting today, Monday, supervise the installation of the new specialized commercial courts in each of the states: Bechar, Tamanguest, Djelfa, Blida, Tlemcen, Algiers, Setif, Annaba, Constantine, Mostaganem, Ouargla, and Oran.
The Executive Decree dated January 14, 2023 specified the jurisdiction of these courts, which consist of a presiding judge assisted by four (4) assistants with a deliberative voice, who were chosen from among those who have extensive knowledge of commercial matters and are subject to training in related fields before assuming their duties. These courts are exclusive to others, according to the ministry’s statement, in disputes of commercial companies, judicial settlement and bankruptcy, disputes of banks and financial institutions with merchants, international trade disputes, maritime disputes, air transport, insurance related to commercial activity, and intellectual property disputes. The procedures before it are distinguished by the obligation to resort to conciliation before registering the case according to specific mechanisms in the Civil and Administrative Procedure Code.
