The Court of Appeal in Paris rejected lawsuits for defamation brought by Morocco against NGOs and French media outlets that exposed or denounced Rabat’s use of the “Pegasus” spyware designed by the Zionist company, NSO.
Initially, the Paris Criminal Court issued ten rulings declaring direct compliance against Le Monde, Radio France, France Médias Monde, Mediapart, L’Humanity, Forbidden Stories and Amnesty International inadmissible.
The Court of Appeal upheld these ten rulings.
The decisions are based on an article of France’s 1881 law on freedom of the press which “does not permit a state which does not possess moral capacity within the meaning of this text to bring proceedings for libel.”
It is worth noting that in Spain, too, the judiciary rejected the lawsuit filed by Morocco against the Spanish journalist, Ignacio Cembrero, who accused the Kingdom of spying on him using the Pegasus program.
A coalition of 17 international media outlets, based on data obtained by Forbidden Stories and Amnesty International in the summer of 2021, after an extensive investigation, revealed that Morocco had resorted to the “Pegasus” program to hack the phones of Moroccan and foreign journalists, politicians, and human rights activists. .
This sparked scandals and sometimes legal action in many countries, including the creation of a European Parliament commission of inquiry.
Once installed on the mobile phone, the Pegasus program allows it to spy on the user of the device and access his messages and data, or activate the device remotely for the purposes of capturing sound or image.
