The Minister of Justice, Keeper of the Seals, Abd al-Rashid Tabi, presented today, Monday, before the Committee on Legal and Administrative Affairs and Freedoms of the National People’s Assembly, a bill amending and supplementing Law No. 06-03, which regulates the profession of judicial bailiffs.
Tabib said that this project falls within the framework of consecrating the ongoing reforms in the justice sector, an embodiment of constitutional provisions and a commitment to the program of the President of the Republic in its part related to the modernization of the judicial facility and the improvement of judicial services, adding that it comes within the framework of reviewing some texts regulating some professions of justice assistants and modernizing them, in order to Keeping pace with reforms and upgrading the role of these professions and their contribution to achieving qualitative and effective justice, as well as improving the performance of the judicial bailiff profession, increasing the pace of implementation of judicial rulings in line with the provisions of the constitution, strengthening mechanisms to combat money laundering and protecting public money. The minister stressed that the amendment is in line with the proposed amendments to the Civil Procedures Law And the administrative one presented to the government, which aims, through the new mechanisms developed, to simplify judicial procedures, facilitate citizens’ access to the judiciary, and reduce the burden on judges and litigants alike.
The project also proposes merging the profession of the auctioneer with the profession of the judicial bailiff in order to strengthen this profession, remove the overlap between the powers of the two professions, and enhance the transparency of consensual and judicial transactions of movable and real estate that was practiced by the auctioneer.
The draft law, which includes regulating the profession of the judicial record, addresses three main axes, related to improving the performance of the profession of the judicial record and modernizing it. The second axis relates to strengthening mechanisms for the implementation of judicial rulings, while the third axis relates to the contribution of the judicial record to combating money laundering and prejudice to public funds. In addition to the abolition of Law No. 16 07 of August 3, 2016 regulating the profession of auctioneer.
