Minister of Labor and Employment: We have lost more than 8 million working days due to strikes – El Hewar Algeria

The Minister of Labor, Employment and Social Security, Faisal bin Talib, revealed that more than 2,000 strikes were recorded between 2013 and 2022, most of which are illegal, stressing that the draft law related to the exercise of the right to strike lays down mechanisms to promote social dialogue and avoid prejudice to other constitutional rights.

The minister said, “The text comes within the framework of embodying one of the broad lines of the government program derived from the directives of the President of the Republic, especially related to the axis of professional relations and social dialogue,” explaining that it repeals and replaces Law No. 90-02.

The senior official in the labor and employment sector stressed that this draft law will enshrine the provisions of the 2020 constitution, especially Article 70 of it, which states that “the right to strike is recognized and exercised within the framework of the law.” Adding, “The law can prevent the exercise of this right, or set limits to its exercise in the fields of national defense and security, or in all public services or activities of vital interest to the nation.”

The minister emphasized that the project mainly aims to promote and strengthen social dialogue and various amicable settlement mechanisms, with the aim of preventing collective labor disputes and establishing solid, solid and lasting professional relations. Especially since all of them are binding, and arbitration takes place at the level of a national committee or state committees and results in the suspension of the strike and the issuance of an enforceable ruling, especially those launched for political reasons or for the purpose of solidarity or for a reason not related to the professional interest of workers or when it comes to an open strike or Launched suddenly or intermittently.

In the same context, the minister mentioned that 2,173 strikes were recorded, 165 of them at the national level between 2013 and 2022, in which more than 1,700,000 workers participated. In this regard, he said: “Most of these strikes are against the law, in addition to the fact that all the lawsuits filed by the bodies used before the judicial authorities led to the illegality of the strike and ordered its immediate cessation.”

He pointed out that the chaos that characterized resorting to strikes cost the institutions significant financial losses, because it led to the loss of more than 8 million working days, so it is expected that the new law will end the previous situation, and the notification of the strike is subject to a time limit set at 10 days, and it is necessary to resolve the strike option. By secret ballot by the simple majority of the workers present in a general assembly comprising at least half of the concerned workers, and in the presence of a judicial report.
