Omar Belhaj: The Constitutional Court aims to modernize the process of addressing the claim of unconstitutionality – Al-Hiwar Al-Jazaeryia

The President of the Constitutional Court, Omar Belhadj, confirmed today, Thursday in Algiers, that his body is working to modernize the course of dealing with the claim of unconstitutionality in a way that serves to provide constitutional justice to the citizen and the litigant.

And in his speech during the conclusion of the two workshops “Liquidating Arguments of Unconstitutionality” and “Mechanisms for Handling Arguments of Unconstitutionality”, Belhadj explained that “the consensus of the participants is on the importance of devoting mechanisms that guarantee the effectiveness and efficacy of the course of addressing the Argument of Unconstitutionality by rationalizing and modernizing the internal work methods of the Constitutional Court , is in line with the court’s endeavors, which aim to provide constitutional justice to the citizen and the litigant.”

And he highlighted that “the process corresponds with the urgent desire of the President of the Republic, Mr. Abdelmadjid Tebboune, who has been insisting on entering the world of digitization in all fields.”

In the same regard, Belhadj considered that “the young Algerian experience in the field of defending unconstitutionality still needs multiple efforts in order to spread the constitutional culture,” adding that “evaluating this system at this stage is premature because it requires reliance on objective justifications and legal and practical data.” clear.”

Regarding the work of the two workshops, which lasted for two days, the President of the Constitutional Court affirmed that “the works achieved their main objectives represented in reviving legal debate and exchanging views between members of the Constitutional Court, judges of the Supreme Court and the State Council, in addition to raising legal and practical problems that arise on the occasion of the implementation of the referral mechanism.” Arguments of unconstitutionality.

By the way, the experts participating in the two workshops praised the Algerian experience in the field of unconstitutionality, considering that “despite its novelty, it has achieved practical success, due to its clear and specific legislative foundations that give each court a clear role, starting with raising the defense of unconstitutionality before a court The matter is then transferred to the Supreme Court, ending with the Constitutional Court,” to be, according to them, “the protective fence of rights and freedoms.”

And the work of the two workshops, organized in cooperation between the Constitutional Court and the United Nations Development Program in Algeria, continued through the support project entitled “The Constitution in the Service of the Citizen”, where it witnessed the exchange of experiences and experiences of the countries of the participating experts, along with members of the Constitutional Court and judges from the Supreme Court and the Council of State.
