The Ministry of Labour, Employment and Social Security called on trade union organizations to ensure that their basic laws conform to the provisions of the new law related to the exercise of the trade union right, especially the provisions of Article 38 thereof, and to send them to the Ministry of Labor, Employment and Social Security within a period of 6 months from the date of the law’s publication in the Official Gazette..
The Ministry of Labor said in a statement today, Monday, That Law No. 23-02 of Shawwal 5 of the year 1444 corresponding to April 25 of the year 2023, related to the exercise of the trade union right, was published in the Official Gazette No. 29 of Shawwal 12 of the year 1444 corresponding to May 02 of the year 2023, according to which Law No. 90 was repealed 14 dated 09 Dhu al-Qi`dah 1410 corresponding to 02 June 1990, related to the modalities of exercising the right to trade union.
The statement adds that, accordingly and pursuant to the provisions of Article 159 of Law No. 23-02 mentioned above, trade union organizations for workers and employees legally established under the provisions of the canceled Law No. 90-14 must conform their basic laws to the provisions of the new law, especially the provisions of Article 38 of it and send it to the Ministry of Labor, Employment and Social Security, Directorate of Labor Relations, for study and opinion, within six (06) months from the date of publishing the law in the Official Gazette, i.e. during the period from May 02, 2023 to November 02, 2023.
The source concluded that the procedures for establishing grassroots trade union organizations, federations and confederations are subject to the provisions of Law No. 23-02 mentioned above, especially the provisions of Articles 28 to 36 thereof.
