The Official Gazette: A joint ministerial decision determines the modalities and deadlines for matching reclaimed agricultural lands – Al-Hiwar Algeria

In Issue 2 of the Official Gazette, a joint ministerial decision was issued specifying the modalities and deadlines for matching the reclaimed lands belonging to the private property of the state, which were not the subject of legal designation and grant procedures.

The decision was signed on November 29 by the Minister of Finance, the Minister of Agriculture and Rural Development, the Minister of Interior, Local Communities and Urban Planning, and the Minister of Public Works, Irrigation and Basic Facilities.

This joint ministerial decision pertains to lands actually reclaimed and with justifications before November 4, 2021 (the date of issuance of Executive Decree No. 21-432 specifying the conditions and modalities for granting lands belonging to private property to the state for reclamation within the framework of the concession), as well as reclaimed lands that were not the subject of private disputes or disputes between the exploiters.

According to this new text, the concerned person submits the conformity request attached to a file at the level of the Directorate of Agricultural Services of the wilaya against a receipt.

The process of matching the reclaimed lands shall last for a period not exceeding 24 months, starting from the date of publication of this decision in the Official Gazette.

With regard to the conformity files, they are studied by a committee established for this purpose with the regionally competent governor, which is charged in particular with ascertaining the status of exploitation of the plot of land subject to conformity and the investments made, verifying the legal nature of the plot and its origin, and approving the area of ​​the plot of land that must be the subject of conformity.

After studying the file, the Director of the Agricultural Departments of the wilaya, based on his proposal, prepares the decision to grant the concession by way of conformity according to the same text that indicates that at a next stage the decision to grant the concession is presented to the governor for signature, and then the beneficiary of the concession is invited as a matter of Compliance with the signing of the book of conditions at the level of the Directorate of the National Office of Agricultural Lands of the wilaya.

According to this joint ministerial decision, the interests of the Land Survey and Land Conservation Directorate of the state must publicize the concession contract within a period not exceeding eight days from the date of its deposit by the State Property Directorate of the state.
